These Terms of Service ("Terms") govern your access to and use of the SkiptheAgent platform, website, and mobile application (collectively, the "Service") operated by Ashcraft Pty Ltd (ACN 699 775 838 | ABN 68 699 775 838), operating as SkiptheAgent ("SkiptheAgent", "we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms.
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.
We may update these Terms from time to time. We will notify you of material changes by email or via a notice on the platform. Continued use of the Service after any such change constitutes your acceptance of the updated Terms.
SkiptheAgent is a software-as-a-service (SaaS) platform that provides private landlords with tools to self-manage residential rental properties. The Service includes features such as:
The Service is a software tool only. SkiptheAgent does not act as a real estate agent, property manager, legal adviser, or financial adviser. All decisions made using the platform remain the sole responsibility of the landlord or tenant. See Section 7 (Disclaimer) for more detail.
To access most features of the Service, you must create an account. You agree to:
Eligibility: You must be at least 18 years of age and an Australian resident to create a landlord account and list properties on SkiptheAgent. Tenants applying for properties must also be at least 18 years of age.
We reserve the right to suspend or terminate accounts that violate these Terms or that we determine, in our sole discretion, are being used for fraudulent or unlawful purposes.
One-time fees (e.g., listing packages): Fees are charged at the time of purchase. One-time fees are non-refundable once the relevant service has been activated or used (for example, once a property listing has been published). If you have not yet activated the service, please contact us within 48 hours of purchase to request a refund.
Subscription fees: Where SkiptheAgent offers recurring subscription plans, your subscription will automatically renew at the end of each billing period unless you cancel. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — no partial refunds are provided for unused time.
Annual Subscription Commitment: When you select the annual Manage plan ($300/year), you are committing to a 12-month subscription. The annual fee is charged upfront and is non-refundable once the billing period commences. You may cancel your annual subscription at any time to prevent auto-renewal, but no refund will be issued for the remaining period of the current 12-month term. The monthly Manage plan ($29/month) has no minimum term and may be cancelled at any time before the next billing cycle.
Payment processing: All payments are processed by Stripe. By providing your payment details, you authorise us to charge the applicable fees to your nominated payment method. All amounts are in Australian Dollars (AUD).
Failed payments: If a payment fails, we will notify you and may temporarily suspend access to premium features until payment is resolved.
You agree not to use the Service to:
We reserve the right to remove any content that violates these rules and to suspend or terminate accounts of users who breach this section.
All intellectual property rights in the Service, including our software, design, trademarks, and content (excluding user-submitted content), are owned by or licensed to Ashcraft Pty Ltd (ACN 699 775 838 | ABN 68 699 775 838), operating as SkiptheAgent. Nothing in these Terms grants you any right to use our name, trademarks, or other intellectual property without our prior written consent.
You retain ownership of content you submit to the platform (such as property photos and descriptions). By submitting content, you grant SkiptheAgent a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content as necessary to provide the Service.
SkiptheAgent is not a licensed real estate agent or property manager. We are a technology platform that provides landlords with self-management tools. Use of the Service does not constitute the provision of real estate services, legal advice, financial advice, or property management services.
Information, templates, and guides available on the platform are provided for general informational purposes only and do not constitute legal or financial advice. You should seek independent legal and financial advice before making any decisions regarding your property or tenancy.
The Service is provided "as is" and "as available" without any warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.
To the maximum extent permitted by Australian law (including the Australian Consumer Law), SkiptheAgent's total liability to you for any claim arising out of or in connection with the Service is limited to the fees you paid to us in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or tenancy income, even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) that cannot be excluded by law.
These Terms are governed by and construed in accordance with the laws of Western Australia, Australia. Ashcraft Pty Ltd (ACN 699 775 838 | ABN 68 699 775 838) is a company registered in Western Australia. You and SkiptheAgent submit to the exclusive jurisdiction of the courts of Western Australia for resolution of any disputes arising under or in connection with these Terms.
We may update these Terms from time to time to reflect changes in our Service, business, or legal requirements. We will provide at least 14 days' notice of material changes by email to your registered address or by displaying a prominent notice on the platform. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance.
